What is your duty to take reasonable care not to make a misrepresentation?

You have a duty to take reasonable care not to make a misrepresentation whenever you apply to vary, extend, or reinstate your insurance.

Before you enter into this contract of insurance, you have a duty to take reasonable care not to make a misrepresentation. You have a similar duty when you ask us to vary, extend, or reinstate the insurance and when we offer you the opportunity to renew your insurance. This means you must provide honest, accurate, and complete answers to any questions we ask.

When you ask us to vary, extend, or reinstate your insurance, you must also carefully review any information we provide to you for confirmation, and let us know of any changes if the information is no longer true, accurate, and/or complete.

If you are unsure of the answers to our questions, or whether the information you previously provided remains correct, you should take the time to check. It is important to understand that when answering questions and reviewing information, you are doing so for yourself and for anyone else to whom the questions apply.

We use your answers to decide what insurance we can offer, to calculate your premium, and to assess any claim you make. If you have any doubts, it is essential that you contact us.

If you do not take reasonable care in answering our questions, or fail to inform us of any changes, you may breach your duty. If this happens, your policy may be cancelled, treated as if it never existed, or a claim may be reduced or denied in full, as permitted by law.

If your circumstances make it difficult for you to answer our questions, or if you are unsure how to explain your situation, you should contact us to discuss your queries.
